ICE Released a Fact Sheet for Child Welfare & Guardianship Stakeholders

The Fact Sheet “ICE Policies and Standard Related to Detained Parents & Legal Guardians Immigration and Customs Enforcement was released in October.

It covers noncitizen parents or legal guardians who are: 1) primary caretakers or have custody of minor child(ren) or incapacitated adults in the United States; and/or 2) those who have a direct interest in family or probate court, guardianship, or child welfare proceedings involving a minor or incapacitated adult.

The Fact Sheet covers Child Welfare, family, or guardianship court proceedings & services, custodial placement of detained covered individuals, phone/video-conference access, parent-minor child visitation, enforcement actions, coordination care or travel of dependent pending removal from the US, repatriation of individuals without their dependent, and facilitation of return.
